The case centered around Nilesh Dhyaneshwar Desale, whose plea was first rejected by the Bombay High Court back in February. Desale, alleged to be a contract killer, is accused of orchestrating a murder plot involving another individual, Sachin, even going so far as to hire other contract killers to carry out the job.
The Bombay High Court's decision to refuse bail was influenced by Desale’s extensive criminal history, which includes nine previous offenses. Despite this background, Desale’s defense team continued to seek leniency, requesting adjournments on three occasions—July 31, September 10, and October 15—citing various reasons each time.
Today’s hearing was different. When Desale’s legal team made yet another request for postponement, Justices Bela M. Trivedi and Satish Chandra Sharma made it clear that enough was enough. Their frustration was palpable as they underscored how frequent adjournments slow down the wheels of justice.
Justice Sharma, speaking more broadly, highlighted the ongoing strain on India’s judicial system. He pointed out that court staff face heavy caseloads and extended work hours, with frequent delays only making matters worse. “The practice of frequent adjournments not only impacts this case but also the efficiency of the entire system,” he emphasized, bringing attention to a long-standing issue within the judiciary.
This ruling serves as a reminder of the judiciary’s commitment to balance fairness with efficiency, ensuring that the rights of all parties are respected without allowing the justice process to be exploited for undue delays.
