In a significant ruling, a Delhi court has denied a woman's request for interim maintenance under the Protection of Women from Domestic Violence Act, citing her ability to support herself. Judicial Magistrate Geeta, who presided over the case, noted that the petitioner, employed in a Union ministry and earning over Rs 43,000 a month, was financially independent.
 
The court highlighted the often fraught nature of matrimonial disputes, where claims can be exaggerated to gain an advantage. While the judge acknowledged the general moral duty of a husband to provide for his wife and children, the specific circumstances of this case pointed to the woman's financial stability, making her ineligible for interim maintenance.
 
The brief duration of the marriage, which lasted only a few months, was also considered in the decision. The court ultimately concluded that the petitioner was "well capable of maintaining herself," and thus did not require financial support from her spouse at this time.
 
This ruling reinforces the principle that interim maintenance under the Domestic Violence Act is not automatically granted but depends on the petitioner’s financial situation and the facts of the case.
